By accessing or using www.feelflo.com (the “Site”) and any services, content, features, or products made available by Flo Labs LLC (“Flo IO,” “Flo,” we,” “us,” “our”), you agree to these Terms of Service (the “Terms”), our Privacy Policy, and our Shipping & Return Policy.
If you do not agree, do not use the Site.
Eligibility & Account
You must be 18 or older to use the Site or purchase products.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We may refuse service, terminate accounts, or cancel orders at our discretion, including for suspected fraud or violation of these Terms.
Changes to These Terms
We may update these Terms at any time by posting a revised version on the Site.
The “Last updated” date reflects the latest change.
Your continued use of the Site after changes post means you accept the updated Terms.
Health & Safety; No Medical Advice
Flo IO currently offers a botanical airway product and related content. We are not a licensed healthcare provider and our products are not marketed as dietary supplements.
Information on the Site is for informational purposes only and is not medical advice.
Always consult a qualified healthcare professional before using any product, especially if pregnant, nursing, taking medication, or managing a medical condition.
FDA Disclaimer: Statements on the Site have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.
Purchases, Pricing & Billing
We may change prices, product descriptions, availability, and promotions at any time.
You authorize us (and our payment processors) to charge your payment method for all purchases, including applicable taxes, shipping, and handling.
All transactions are subject to validation and authorization by your card issuer; we are not liable for delayed or non-delivery due to declined or flagged payments.
Subscriptions
If you purchase a subscription, you agree to recurring charges at the stated interval until you cancel.
You can manage or cancel your subscription in your Flo IO account or by emailing hello@feelflo.com.
Cancellation takes effect for future charges and shipments. Charges already processed are handled under our refund policy.
Shipping, Delivery & Risk of Loss
Title and risk of loss transfer to you upon delivery to the carrier.
We are not liable for carrier delays, customs holds, or incorrect shipping information provided at checkout.
International customers are responsible for import duties, taxes, and compliance with local laws. If an order is refused or returned due to customs issues, we cannot issue a refund.
Returns & Refunds (Summary)
We do not accept physical returns.
30-Day Feel-It Guarantee (First Order Only): For your first order (one-time or first subscription), if you don’t feel the difference within 30 days of delivery, we’ll refund the product price minus $7.95 shipping & handling — no return required.
Limit: One refund per customer. Exclusion: 3-pack bundles and any repeat purchases are not eligible.

Marketing Communications (Email & SMS)
By providing your email address and/or mobile number on the Site, you agree to receive marketing and transactional communications from Flo IO, including recurring text messages and promotional emails.
Message frequency varies. Message and data rates may apply.
Consent is not a condition of purchase.
You can opt out at any time:

SMS: Reply STOP to cancel or HELP for help.
We may use third-party providers to deliver these messages and to manage our subscriber database.

Acceptable Use
You agree not to:

Post or transmit anything unlawful, defamatory, obscene, harassing, or misleading.
Interfere with the Site’s operation (e.g., malware, scraping, reverse engineering).

Misrepresent your identity or affiliation.
We may monitor, remove, or restrict access where we reasonably believe these Terms are violated.
User Content & Feedback
If you submit reviews, comments, photos, videos, or suggestions (“User Content”):
You represent you have all necessary rights and that your User Content is accurate and lawful.
You grant Flo IO a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, display, and create derivative works from your User Content in any media now known or later developed.
We may, but are not obligated to, monitor, edit, or remove User Content.
Intellectual Property
The Site, products, text, graphics, logos, icons, images, software, and other materials (collectively, “Flo IO Content”) are owned by or licensed to Flo IO and protected by intellectual property laws.
You may view the Site and download one copy of materials for personal, non-commercial use, provided you do not remove proprietary notices.
You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from Flo IO Content without prior written consent.
All trademarks, service marks, and trade dress are the property of Flo IO or their respective owners.

The Site may link to or integrate third-party websites or services. We do not control, endorse, or assume responsibility for third-party content, policies, or practices. Your dealings with such third parties are solely between you and the third party.
Promotions & Discount Codes
Promotions and discount codes are subject to the terms posted with each offer and may be modified or discontinued at any time. We may void or refuse a discount in cases of suspected misuse or public posting of private codes.
Disclaimer of Warranties
The Site, products, and all content are provided “as is” and “as available” without warranties of any kind, express or implied.
To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

Our total liability to you for all claims shall not exceed the amount you paid to Flo IO for the product or service at issue in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Flo IO and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or products, violation of these Terms, or infringement of any rights of another person or entity.
Dispute Resolution & Arbitration
Informal Resolution: Before filing a claim, email hello@feelflo.com with your name, contact information, a description of the dispute, and the requested relief. We’ll attempt to resolve in good faith within 60 days.
Binding Arbitration: Except for claims that qualify for small claims court, any dispute arising from or relating to these Terms or your use of the Site or products will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Location: Arbitration will take place in Austin, Texas, or by remote session if mutually agreed.
Class-Action Waiver: You and Flo IO agree to bring disputes only on an individual basis, not as part of any class or representative action.
Opt-Out: You may opt out within 30 days of accepting these Terms by emailing hello@feelflo.com with the subject line “Arbitration Opt-Out” and your full name and contact information.
Electronic Communications & E-Sign Consent
By using the Site or communicating with us electronically, you consent to receive notices, agreements, disclosures, and other communications electronically.
Your actions on the Site (e.g., clicking “Place Order,” checking boxes) constitute your electronic signature under the U.S. E-SIGN Act, signifying your agreement to these Terms and all related policies.
Termination
We may suspend or terminate your access to the Site or your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Site ends immediately, but the provisions on intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution will survive.
International Use
We operate from the United States. You are responsible for complying with local laws if you access the Site from outside the U.S.
You represent that you are not located in a country subject to U.S. embargo or on any U.S. government restricted party list.
Miscellaneous
Governing Law & Venue: These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to arbitration, courts in Travis County, Texas have exclusive jurisdiction.
Severability: If any provision is found unenforceable, the remainder remains in effect.
No Waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment: You may not assign these Terms without written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Entire Agreement: These Terms, together with our Privacy Policy and Shipping & Return Policy, form the entire agreement between you and Flo IO regarding your use of the Site and products.
